Brigadier General Benjamin Silo, PRO 11 director has already ordered the conduct of the investigation and filing of appropriate criminal charges against individuals who post and publish any false or fake news that endanger the public order in the region.
This came after a series of fake news and information about incidents of alleged hold-ups, kidnapping, and rape in particular areas in Davao City, Digos City, in Davao del Sur, and Panabo City in Davao del Norte.
The Regional Police in its statement Saturday morning (Aug. 27) said that immediately, personnel from the Regional Special Operations Group together with the Regional Intelligence Division (RID), personnel from Davao City Police Office and the Regional Anti-Cybercrime Unit conducted an in depth investigation.
The investigating team has identified Charles Japheth Lagradante Luzada, who was behind the social media post regarding the report of areas where alleged robbery incidents are prevalent.
Luzada has since issued a public apology on his social media account for posting fake news.
Investigators are now preparing complaints for violation of Article 154 of the Revised Penal Code, which states: Any person who by means of printing, lithography, or any other means of publication shall publish or cause to be published as news any false news which may endanger the public order, or cause damage to the interest or credit of the State.
In relation to Cybercrime Prevention Act of 2012 or Republic Act No. 10175 the penalties for crimes committed by, through and with the use of information and communications technologies shall be one degree higher.
Likewise under Republic Act 10591, the penalty for violations of Article 154 shall be imprisonment for six (6) months and a fine ranging from P40,000 to P 200,000.
Silo said, “fake news spreading in social media is very alarming, it has already caused panic and fear to the people, likewise, discredits the effort of our police in maintaining peace and order.”
Silo said he hopes that this will serve as a warning to the public to avoid spreading false information and posting fake news on any social media platforms.
He also vowed to pursue and investigate any post for clout which may affect public safety and order, adding the police is committed to safeguarding the community by providing maximum efforts and police visibility to deter the commission of crimes in the region.
Silo also encourages the public to remain vigilant at all times and never hesitate to report any suspicious activities to the nearest police station and cooperate with the law enforcement authorities.
